In the last years of his life, Gerald C. MacCallum, Jr., defied illness to continue his work on the philosophy of law. This book is a monument to MacCallum’s effort, containing fourteen of his essays, five of them published here for the first time. Two of those previously published are widely admired and reprinted: “Legislative Intent,” certainly one of the best papers ever published on its topic, and “Negative and Positive Freedom,” which offered a new way of looking at (...) a distinction that had been canonical for the last two centuries. To complete MacCallum’s unfinished pieces, Marcus G. Singer and Rex Martin painstakingly consulted MacCallum’s notes for planned revisions. MacCallum discusses legal reasoning, the application of rules, the interpretation of statutes and constitutional provisions, and the relation of these matters to morality and justice. In the last decade of his working life, he became greatly concerned with the interrelated themes of integrity, autonomy, conscience, and violence. He wished to relate competition to morality and justice to adversarial systems of law. These themes are woven together in Legislative Intent and constitute the main subject of some of the essays. MacCallum was engaged in a constant search for truth and understanding, and in his life and work lived up to Emerson’s vision of the “American Scholar” as a “human being thinking.” These essays are informed by the author’s deep curiosity, penetrating intelligence, wide knowledge, and outstanding character. Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

Visual thinking in mathematics is widespread; it also has diverse kinds and uses. Which of these uses is legitimate? What epistemic roles, if any, can visualization play in mathematics? These are the central philosophical questions in this area. In this introduction I aim to show that visual thinking does have epistemically significant uses. The discussion focuses mainly on visual thinking in proof and discovery and touches lightly on its role in understanding.

The formal sciences, particularly mathematics, have had a profound influence on the development of linguistics. This insightful overview looks at techniques that were introduced in the fields of mathematics, logic and philosophy during the twentieth century, and explores their effect on the work of various linguists. If a woman in the audience at a presentation raises her hand, we would take this as evidence that she intends to ask a question. In normal circumstances, we would be right to say that she raises her hand because she intends to ask a question. We also expect that there could, in principle, be a causal explanation of her hand’s rising in purely physiological terms. Ordinarily, we take the existence and compatibility of both kinds of causes for granted. But (...) this can come to seem strange. When we imagine tracking the physiological process that culminates in her hand’s rising, it is hard to find a purchase for her intention. The physiological process seems not to need assistance from her intention in order to get where it’s going, chugging along as it does according to principles that appear to have very little in common with ordinary psychological ones. The presumed self-sufficiency of physiological processes can, in a similar fashion, appear to muscle psychological states quite generally out of the causal picture. (shrink)

David Walker’s famous 1829 Appeal to the Colored Citizens of the World expresses a puzzle at the very outset. What are we to make of the use of “Citizens” in the title given the denial of political rights to African Americans? This essay argues that the pamphlet relies on the cultural and linguistic norms associated with the term appeal in order to call into existence the political standing of black folks. Walker’s use of citizen does not need to rely on (...) a recognitive legal relationship precisely because it is the practice of judging that illuminates one’s political, indeed, citizenly standing. Properly understood, the Appeal aspires to transform blacks and whites, and when it informs the prophetic dimension of the text, it tilts the entire pamphlet in a democratic direction. This is the political power of the pamphlet; it exemplifies the call-and-response logic of democratic self-governance. (shrink)

Hill and Levine offer alternative explanations of these conceivabilities, concluding that these conceivabilities are thereby defeated as evidence. However, this strategy fails because their explanations generalize to all conceivability judgments concerning phenomenal states. Consequently, one could defend absolutely any theory of phenomenal states against conceivability arguments in just this way. This result conflicts with too many of our common sense beliefs about the evidential value of conceivability with respect to phenomenal states. Vann McGee claims that open-ended schemas are more innocuous than ordinary second-order quantification, particularly in terms of ontological commitment. We argue that this is not the case.

Let me begin with a stylized contrast between two ways of thinking about morality. On the one hand, morality can be understood as the dictate of, or uncovered by, impartial reason. That which is (truly) moral must be capable of being verified by everyone’s reasoning from a suitably impartial perspective. If we are to respect the free and equal nature of each person, each must (in some sense) rationally validate the requirements of morality. If we take this view, the genuine (...) requirements of morality are a matter of rational reflection and self-imposed law. For Kant it seemed to be a matter of reflection by a rational individual, testing the impartiality of his maxims. For Rousseau, who was an important influence on Kant, under the proper conditions collective deliberation could yield impartial rules of justice that are willed by all. From another point of view moralities are social facts with histories. The heroes of this tradition are Hume, Ferguson and, perhaps surprisingly given his “deductive” method, Hobbes. The moral codes — or if “code” implies too much systematization, moral “practices” — we have ended up with are, to some extent, a matter of chance. This is by no means to say that morality is entirely arbitrary, but it does contain a significant arbitrary element. The morality we have ended up with is path-dependent: only because our moral codes have started somewhere, and have changed in response to unanticipated events, can we explain why we ended up where we have, and different societies end up in different places. The proponents of each view typically seek to discredit the other. Those who conceive of morality as the demand of impartial reason often insist the evolutionists confuse “positive morality” (the moral code that people actually follow) with justified (or true) morality, which is revealed by impartial reason. The positive morality that has evolved is simply what people think is morality, not what really is morality.. (shrink)

This essay explores the nihilistic nature of the idea of postmodern aesthetics in the Western world by highlighting its historical and cultural specificity in contrast with non-Western postmodernities, in particular in East Asia, and this in spite of their formal similarities. We then have to question the nature, possibility and implication of Western postmodern aesthetics overcoming itself within the context of globalisation.

Compared to other debates in contemporary political philosophy, the light-to-heat ratio of discussions of neutrality has been somewhat dismal. Although most political philosophers seem to know whether they are for it or against it, there is considerable confusion about what “it” is. To be sure, some of this ambiguity has been noted, and at least partially dealt with, in the literature. Neutrality understood as a constraint on the sorts of reasons that may be advanced to justify state action is regularly (...) distinguished from “consequential neutrality”—that the effects of state policy must somehow be neutral.1 Yet interpretations of neutrality are far more diverse than most analyses recognize.2 Neutrality is sometimes understood as a doctrine about: the intent or aim of legislation or legislators,3 the proper functions of the state,4 the prohibition of the state “taking a stand” on some issues,5 the prohibition of the state enforcing moral character,6 or the requirement that the state take a stance of impartiality.7 Alternatively, neutrality can be understood as a requirement of a theory justice rather than state action.8 There are also differences about whether neutral states (or theories.. In this article I discuss the text of five passages in Lucretius’ de rerum natura (2.1082, 3.21, 5.1082, 6.743, 6.1082). Each of them has a Greek model on which Lucretius draws, and which scholars of Lucretius have not yet fully exploited in the interpretation of the poem or in the restitution of its text.
